H.S Diamonds Ltd. was established in 1976 as a member of the Israel Diamond Exchange (The Bursa) with offices located on the 8th floor. The Israel Diamond Exchange is an accredited exchange as part of the World Federation of Diamond Bourses (WFDB) and is one of only two in the Middle East. The Terms and Conditions outlined in this document apply solely to products sold through H.S Diamonds Ltd. as well as the H.S Diamonds web site located at https://hsdiamonds.com. The Terms and Conditions outlined in this document DO NOT apply to all products sold through the WFDB or Israel Diamond Exchange. BY VISITING AND/OR USING THIS SITE IN ANY WAY, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO THESE TERMS AND CONDITIONS.

The H.S Diamonds website (https://hsdiamonds.com) is owned and operated by H.S Diamonds Ltd. Unless otherwise noted, all design and content included on this web site, including text, graphics, logos, icons, images, artwork, audio and video clips and software is the property of H.S Diamonds (or is used under license to H.S Diamonds) and is protected by Israeli and international copyright laws.

Change of Terms

H.S Diamonds may, at its sole discretion, revise and/or add new terms to these Terms and Conditions from time to time without notice to you. Any revisions and additions shall be deemed effective immediately upon notice, which H.S Diamonds may give by any means, including, without limitation, by posting the revised Terms and Conditions on the H.S Diamonds website. Customers are solely responsible for reviewing H.S Diamonds Terms and Conditions before making a purchase to weigh how these Conditions that may affect rights or obligations. Any access or use by you to https://hsdiamonds.com after changes to the Terms and Conditions will constitute your acceptance of the revised terms. If you do not agree to the amended terms, you must stop using the H.S Diamonds website.

Product Display & Descriptions

H.S Diamonds makes all reasonable efforts to display the products listed for sale on its web site as accurately as possible. However, display and color capabilities of your computer monitor may affect the colors, textures, or details that you actually see on your screen. Products may appear on the H.S Diamonds website larger or smaller than their actual size. H.S Diamonds cannot guarantee that your monitor's display of any product color, texture or detail will be accurate. In addition, H.S Diamonds does not warrant that product descriptions or other content are accurate, complete, or error free. While H.S Diamonds makes every effort to ensure that our products are described and priced accurately, rare circumstances, data, including prices, may be inaccurately displayed on the H.S Diamonds website due to system and/or typographical errors which may occur. Inadvertent errors or inaccurate advertised prices are not binding on H.S Diamonds, and may be adjusted by H.S Diamonds at any time. In the event that an item is deemed to be priced incorrectly, H.S Diamonds reserves the right to refuse sale of that item. If the pricing error is discovered after payment has been finalized, H.S Diamonds reserves the right to cancel the sale and refund the transaction in full. If a product purchased through H.S Diamonds or the H.S Diamonds website is not as described, your sole remedy is to return it in unused condition.

Dispute Resolution

Any dispute arising with respect to these Terms and Conditions shall be resolved by negotiation between the parties or, if necessary, by resort to an appropriate federal or local court located in Israel.

Your Order

When you access or use the H.S Diamonds website, you are solely responsible for maintaining the confidentiality of your account and for restricting access to your computer. You are further responsible for all activities that occur under your personal account and your password. If you are under the age of 18 years old, you may use https://hsdiamonds.com only under the guidance and direction of a parent or guardian. Please note that H.S Diamonds reserves the right, in its sole discretion, to refuse service, remove or edit content or cancel orders.

In the case where a customer files a chargeback with their credit card company, H.S Diamonds has the right to recover its direct and indirect costs, and cancel any promotional items, free shipping, or other benefits, as determined in H.S Diamond's sole and absolute discretion

Diamond Certificates

When you order a loose diamond, H.S Diamonds will ship it to you with the accompanying diamond certificate which is a diamond grading report. These grading reports are detailed documents created by diamond grading experts at highly-respected diamond laboratories. These diamond grading reports are extremely expensive to replace and as a result of this, H.S Diamonds requires each diamond grading report to be included with each returned diamond. If you do not include the diamond grading report with your return, you will be charged a replacement fee of two hundred and fifty dollars ($250.00).

Diamond Upgrade Program

H.S Diamonds is proud to offer a free lifetime diamond upgrade. Any loose natural diamond purchased from H.S Diamonds can be exchanged for credit equivalent to the original purchase price for a new diamond that is at least fifty percent greater value. In order to be eligible, the diamond being upgraded must be accompanied with original documentation including the diamond grading report and certificate of authenticity and must be in saleable condition. Upgrades are not available for colored gemstones or settings and jewelry. Upgrade credit does not include duty or tax paid on the original purchase. All applicable duties and taxes will be charged on the full retail price of the new diamond before any credit is applied.

Privacy Policy

By using https://hsdiamonds.com or interacting with us offline, you agree to our Privacy Policy and to our collection, use, and disclosure practices and other activities as described in this Privacy Policy. If you do not agree and consent, you must discontinue use of the H.S Diamonds website.

(“H.S Diamonds”, “we”, “our” or “us”) collects, why we collect this information, and how we use the information we collect as well as your rights and choices regarding such information. In no event shall H.S Diamonds' liability be greater than the price you paid for the product or service that is the basis for the claim.

Some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. It is your responsibility to check local laws for any restrictions or limitations regarding the exclusions of implied warranties.

Shipping Policies

H.S Diamonds is proud to offer our entire collection of jewelry, custom pieces, and loose diamonds to customers all over the world free of shipping charges. However, YOU ARE RESPONSIBLE FOR ANY AND ALL DUTIES, GST/PST/HST/VAT, TAXES, LUXURY ITEM TAXES OR SURCHARGES LEVIED BY YOUR COUNTRY OF DELIVERY. It is the sole responsibility of the customer to check with your local authorities prior to placing your order to calculate taxes and duties. Should a situation arise where payment of taxes and duties fails to be made, your product may be seized by customs and we will be unable to refund your purchase. H.S. Diamonds does not under any circumstance accept forced returns by way of failure to pay duties, GST/PST/HST/VAT, taxes, luxury item taxes, or surcharges at customs. In the event a customer attempts to initiate a forced return by way of customs, H.S. Diamonds reserves the right to refuse the return and your money will not be refunded. H.S. Diamonds is unable to reroute packages or change the delivery address once an order has already shipped due to security and insurance considerations.

Should special circumstances occur, H.S Diamonds reserves the explicit right to accept or decline exceptions to this policy at their full discretion. In the event an exception to the shipping policy is made, the customer is fully liable for any charges incurred to H.S. Diamonds which must be paid before H.S. Diamonds initiates the process to free your purchase from customs or change its delivery address.

Secure shipping and insurance is provided by Brink's Global Services or an equivalent secure delivery service to all our shipping destinations, regardless of the order amount. For added security, a signature will be required upon delivery of all H.S Diamonds orders. An adult 18 years or older must be available at the business or home address to sign for receipt. Additional procedures may vary by country. It is the responsibility of the customer to be aware of and comply with local protocols in order to receive their package.

All items are fully insured while in transit to your home or office. Most shipments outside of Israel arrive within two to five business days, however the customs process in each country may vary and often packages may be held longer. Please check with your local authorities to determine if customs holding costs may apply. All H.S. Diamonds products are shipped once they have passed through our thorough quality control. Loose diamonds are shipped immediately after passing inspection. All other jewelry and engagement rings will be shipped in one to three weeks, depending on the production schedule of the item(s).

Third Party Brokerage

In some cases, third party brokerage may be necessary in order for shipments to be fulfilled in certain countries (Note: shipments to France may require third party brokerage). Please note that H.S. Diamonds ltd does not endorse or claim any control over any third party brokerage, and is unable to undertake responsibility to review third party brokerage content and polices.

Restrictions

Please note that H.S Diamonds items shipped outside of the US, Canada, and Israel may not be in accordance with specific standards of the destination country indicated in the shipping address provided. H.S Diamonds is not responsible for determining which products can be legally imported into countries outside of the US, Canada, and Israel. For questions regarding possible shipping restrictions to your shipping address of choice, please check with your local authorities.

Returns, Exchanges & Resizing

At H.S Diamonds, we take pride that our jewelry is produced with the highest standards of quality and excellence. In order to make sure you are completely satisfied with your H.S Diamonds purchase, we offer a 30 day return and exchange policy for all standard products shipped worldwide. We are not able to accept returns or exchanges of custom or engraved products. In order to initiate the return process, a customer must first receive their package from customs, then ship it back to us. For purchases both within Israel and internationally, the customer is responsible for paying return shipping costs. WE HIGHLY RECOMMEND THAT YOU SHIP YOUR PRODUCT WITH A TRACKABLE TRUSTED CARRIER AND PURCHASE SHIPPING INSURANCE. H.S Diamonds is not liable for products lost, stolen, or damaged during return shipping. Should loss, theft, or damage occur during return shipping, it is the sole responsibility of the customer to file a claim with their mail carrier. H.S Diamonds is unable to refund lost, stolen, or damaged products under any circumstance.

In the case of exchanges, the customer is responsible for paying shipping both ways as well as any additional duties, GST/PST/HST/VAT, taxes, luxury item taxes, or surcharges incurred in their respective country. International customers please note that if you choose to exchange an item, taxes are levied every time a jewelry item crosses the border. Customers within Israel may avoid return/exchange shipping charges by dropping off and/or picking up the product they wish to return or exchange at our Tel Aviv offices. Customers MUST CALL AND MAKE AN APPOINTMENT BEFOREHAND and bring a valid government ID in order to be allowed entry to our offices for any reason. The Israel Diamond Exchange is a secure building and we will need to grant you a security pass.

Recipients of orders shipped within Israel are eligible for free ring resizing in our Tel Aviv office. In order to be eligible for a free ring resizing, you must make an appointment and bring the ring, accompanying certificate of authenticity, and government ID to our Tel Aviv office. For orders shipped internationally, we cannot offer ring resizing since taxes are levied every time a jewelry item crosses the border. We encourage international customers to bring their ring to a trusted jeweler in their country for resizing.

Free Lifetime Manufacturing Warranty

We stand behind the quality and craftsmanship of our jewelry. H.S Diamonds offers a free lifetime warranty against manufacturing defects on all H.S Diamonds fine jewelry.

If you experience damage to your purchase due to manufacturing, we recommend you contact us so we may evaluate the damage to your piece. An $80 deposit will be taken before the shipment of your item to H.S Diamonds for evaluation, which covers the cost of shipping the item and an evaluation by our expert jewelers to determine if the damage is warrantied. This fee is refunded in full for all warrantied repairs. We also offer complimentary shipping back to the customer for all warrantied repairs. Repairs that are not covered under the lifetime warranty will have a price quoted to the customer, including return shipping, for approval before work is performed. If approved, the deposit will be applied to this repair. If the customer chooses not to perform the repair, the deposit will be applied to cover the shipping charge back to the customer after evaluation.

If a warranty issue is found, H.S Diamonds will repair the warrantied damage or replace the item without charge.

Repair or service performed by a jeweler other than H.S Diamonds will void the warranty. All fine jewelry can be affected by normal wear, activities, or trauma. This is especially true for rings, since hands are actively used and subject to daily pressure. Our manufacturing warranty excludes coverage for wear and tear, loss of gemstones, product loss, or theft. Coverage also excludes damage or loss caused by a failure to obtain the repairs required to preserve the integrity of the jewelry.

Some examples of common jewelry issues that WOULD NOT be considered manufacturing defects include:

  • The discoloration of precious metals caused by chemicals, make-up, immersion in pools and hot tubs, or bathing.
  • Precious metals, and especially prongs, wear down over time and may require restoration work as part of normal wear.
  • Prongs catching, wearing out, or bending over time due to everyday wear or normal damage, allowing a gemstone to fall out.
  • The loss of a gemstone caused by damage from everyday wear or from other damage.

Payment

We accept payment via most major credit cards, PayPal, and bank wire / international money transfer (IMT). Please note that production of custom orders begins when your payment has been processed. Bank wires may take up to 3 business days to be received.

Credit Cards

Credit card payments are processed via one of Israel’s largest online secure payment systems called iCount. We are able to accept payments made via VISA, MasterCard, AMEX, Discover, JCB, and Diners Club. Payments must be made in US Dollars (USD) or New Israeli Shekel (ILS).

Most purchases are eligible for multiple payment financing options up to 12 months interest free as indicated in the “number of payments” field at checkout. Non-Israeli credit cards may have limited eligibility for this program.

For customers outside of Israel, please enter your passport or driver’s licence number in the “VAT ID / ID” field. We require a valid ID in order to confirm your identity at the time of your product delivery.

PayPal

If you do not wish to share your financial information with us or wish to pay in a currency other than USD or ILS, PayPal allows you to make payments through their platform using a variety of methods including: PayPal Cash or PayPal Cash Plus account balance, your bank account, PayPal Credit, debit or credit cards, and rewards balance.

Bank Wire / International Money Transfer (IMT)

If you wish to pay via bank wire / IMT, please contact us for payment instructions and bank details. Bank wires may take up to 3 business days to be received.

*Banks may charge a fee for the transmission of a bank wire. Please ensure that your bank has included this fee when processing your bank wire. There are no fees from our bank to receive the bank wire.

Indemnification

The customer agrees to protect and language the H.S. Diamonds Ltd., its independent contractors, service providers and consultants, its employees and agents against all claims, losses, damages, liabilities, expenses and costs, resulting from breach of terms of use, customer access to the site or inability to use and browse the site including any claim, demand, claim Actual or threatened against the company and / or independent contractors, service providers, employees, consultants, resulting from reference to the content, conduct and violations of these terms and conditions, or violation of the rights of any third party.
